Speaker Program Compliance

The rules that govern HCP-paid speaker programs: fair market value, on-label content, and public reporting.

Speaker program compliance covers the rules a pharma company has to follow when it pays an HCP to present on its behalf, usually to other prescribers. Three things matter most: the speaker's compensation has to reflect fair market value for their time and expertise, not a disguised incentive to prescribe. The content has to stay within the approved slide deck, on-label only, with no live deviation into unapproved claims. And the payment itself has to be publicly reported under the federal Physician Payments Sunshine Act, through CMS's Open Payments database.

The slide deck a speaker presents from goes through the same MLR and PRC approval as any other promotional asset, which is why speakers are typically required to use it as approved rather than their own slides or talking points.
